The Analysis on protection of the right to property in the context of Article 1 Protocol 1 of the European Convention on Human Rights (ECtHR) is published in Montenegrin and English languages.
The Analysis is developed within the framework of activities aimed at harmonising court practice, focusing on the interpretation of human rights standards in the practice of the Constitutional Court and Supreme Court of Montenegro. It consists of three chapters targeting concrete issues, such as the right to property in the practice of the ECtHR, confiscation of possessions by the state, and property rights deriving from contractual obligations. It will ultimately serve as a toolkit for legal practitioners in applying the jurisprudence of the Court in Strasbourg at the national level.
The Analysis was prepared within the action "Improved procedural safeguards in judicial proceedings in Montenegro", that is a part of the joint European Union/Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
