Horizontal Facility

As part of ongoing efforts to support judicial reform and strengthen the quality of administrative justice in Montenegro, a new Handbook on Legal Reasoning in Administrative Disputes has been published and disseminated to all judges and legal advisors of the Administrative Court of Montenegro.

The Handbook builds upon the capacity-building activities previously implemented under the action “Strengthening accountability of the judicial system and enhancing protection of victims' rights in Montenegro” aiming to enhance legal reasoning and align domestic jurisprudence with European standards under the framework of the Horizontal Facility for the Western Balkans and Türkiye.

In addition to the extensive reference to the European Court of Human Rights’ case law, the Handbook offers practical guidance and analytical tools to promote consistent and well-reasoned decisions in administrative disputes. It aims to prevent the recurrence of similar cases, while strengthening legal certainty and enhancing the overall quality of justice.

By equipping judicial professionals with this resource, the European Union and the Council of Europe continue to contribute to the improvement of judicial practice and the protection of fundamental rights in administrative proceedings.
