Montenegro adopts new Code of Professional Conduct for Lawyers, strengthening accountability and public trust

Montenegro has taken an important step forward in advancing the rule of law with the adoption of a new Code of Professional Conduct for Lawyers. The Code was developed with the support of the Council of Europe, drawing on European standards and best practices to reinforce professionalism, accountability, and legal certainty.

The new Code aligns with the principles of the Council of Bars and Law Societies of Europe, as well as the European Model Code of Ethics for Lawyers. It also incorporates relevant standards and jurisprudence of the European Court of Human Rights, particularly in areas such as professional duties, relations with clients, confidentiality, and public statements by lawyers in relation to ongoing cases.

Replacing the previous Code adopted in 1999, which no longer reflected contemporary legal and professional standards, the new framework introduces a more robust and comprehensive approach to ethical conduct. It strengthens the ethical responsibility and accountability of lawyers, while providing clearer guidance for their professional behavior in an evolving legal environment.

For citizens, the new Code brings increased legal certainty and stronger safeguards in their interactions with legal professionals. By reinforcing standards of integrity, independence, and responsibility within the legal profession, it contributes to building greater public confidence in the justice system.

The adoption of the Code also marks a significant contribution to the implementation of the judicial reform agenda, supporting ongoing efforts to align the legal system of Montenegro with European standards.

Support for the development of the Code was provided under the action "Strengthening accountability of the judicial system and enhancing protection of victims' rights in Montenegro", implemented within the joint programme of the European Union and the Council of Europe, “Horizontal Facility for the Western Balkans and Türkiye.”
