Advancing European standards in Macedonian courts: Analysis of the case-law on freedom of expression and safety of journalists

Effective judicial protection of freedom of expression is key in a democratic society. To address how the Republic of North Macedonia has advanced in this field a thorough analysis of the domestic case-law has been prepared.

The analysis is covering the period from 1 January 2016 to 1 June 2022 and delves into the application of Article 10 of the European Convention of Human Rights and the related principles established by the European Court for Human Rights within Macedonian courts. This assessment not only spotlights the progress achieved in ensuring protection of freedom of expression in line with European standards, but also identifies areas for enhancement. Moreover, it offers recommendations for further improvement in certain areas.

For legal professionals and all those concerned with this vital topic, this analysis stands as a remarkable resource, shedding light on the country’s commitment to freedom of expression and the efforts of the public authorities in North Macedonia to advance freedom of expression and freedom of media.

The analysis is now available in both English and Macedonian language. The research was conducted under the Horizontal Facility II programme, while the publication and translation in Macedonian language were produced under the joint European Union and the Council of Europe, Horizontal Facility III programme , and its respective action “Protecting freedom of expression and of the media in North Macedonia” (PRO-FREX).
