The Supreme Court launches new publication on harmonisation of judicial practice in Albania

Harmonisation of domestic judicial practice, in accordance with the case law of the European Court of Human Rights (ECtHR), is crucial to strengthening legal certainty and rule of law principles. This represents a key priority within the European Union and Council of Europe Action "Improving the protection of the right to property and facilitating executions of ECtHR judgments in Albania (D-REX III)". As one of the main beneficiaries and partners of the Action, the co-operation with the Albanian Supreme Court involves a number of interventions, including the enrichment of domestic resources on landmark decisions with unification value.  

Following previous successful initiatives of publishing summaries of judgements from Albanian judicial practice, a third resource material, for the period 2021-2023, is prepared for Albanian judges of First Instance and Appeal courts, prosecutors, and lawyers, as a tool for to strengthen uniform implementation of the most important decisions of the High Court, as well as to nurture legal precedent between judicial institutions and other legal professionals.

One of the pillars of the publication consists of important and unifying decisions of the Court on the right to property, in accordance with Article 1, Protocol 1 of the European Convention on Human Rights. The selected case law is distributed in three separate sections of the publication that regulate a wide group of legal institutes, such as public expropriation, financial assessment of property, registration of property titles, etc. 

On this occasion, a handover ceremony was organised at the auspices of the Supreme Court on Monday, 13 May, where the Head of the CoE Office in Tirana Giulia Re and the Chair of the Supreme Court, Sokol Sadushi, emphasised the importance of this initiative.

This publication was prepared in the framework of the Horizontal Facility III programme, co'funded by the EU and Council of Europe and implemented by the Council of Europe.
