Expert discussion on enhancement of the procedural guarantees for persons deprived of liberty in Montenegro

Substantive efforts are made by Montenegrin authorities to fully align the legislative practices in the area of procedural rights with the EU legislation and relevant case-law of the European Court of Human Rights (ECtHR), particularly focusing on the rights of persons deprived of liberty.

With that aim, the expert discussion was organised on 21 October 2020, bringing together representatives of the Supreme Court, State Prosecution, Ministry of Justice, National Agent before the ECtHR, European Commission and Council of Europe. The baseline for discussion were findings provided in the analysis on the rights of persons deprived of liberty, which offered recommendations to further enhance procedural safeguards in criminal proceedings.

The solutions offered for the legislative changes will be further addressed by a working group, with the aim to review the criminal procedural law in line with EU Directives and standards of the ECtHR.

The action "Improved procedural safeguards in judicial proceedings in Montenegro" is a part of the joint European Union/Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
