Supporting the role of local government on the treatment of property registration processes

A series of three outreach monitoring activities were held, in the Municipalities of Librazhd (28 March) , Berat (3 April) and Malësi e Madhe (9 April), to collect data on the involvement of local government institutions in handling remaining key issues in property registration.

Representatives of the cadastral and urban planning sectors provided their valuable technical insight into how local government can play an important role in guaranteeing the principle of legal certainty and the values embodied in the European Convention on Human Rights on the right to property, pursuant to Law no. 20/2020 "On the finalization of transitional ownership processes in the Republic of Albania". During the monitoring activities, challenges and practical issues faced by the municipal cadastral offices on the process of agricultural land titles registration, the immediate need for unification of cadastral maps, and strengthening of inter-institutional coordination on the process of initial property registration and registration of state property, were specifically identified. In addition, possible suggestions were proposed on establishing specific separation of administrative competences between local and central government regarding legalization processes.

This pilot monitoring in few selected municipalities supported by EU and Council of Europe aims at identifying suitable measures for strengthening the capacities of cadastral offices representatives in local municipalities regarding the treatment of property issues.

This initiative aligns with the action on “Improving the protection of the right to property and facilitating the execution of ECtHR judgments in Albania (D-REX III)”, under the European Union and the Council of Europe joint programme "Horizontal Facility for the Western Balkans and Türkiye".

 


 


 


 

 

Horizontal Facility III

The joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye” (Horizontal Facility III) is a co-operation initiative, running from 2023 until 2026.

The programme covers actions in Albania, Bosnia and Herzegovina, Kosovo*, Montenegro, North Macedonia, Serbia and Türkiye. It enables the Beneficiaries to meet their reform agendas in the fields of human rights, rule of law and democracy and to comply with European standards, which is also a priority for the EU enlargement process.

The third phase of the programme is worth €41 million (85% funded by the European Union, 15% by the Council of Europe).
