Further steps taken towards strengthening the victims’ right in the criminal proceedings

The Action "Improved procedural safeguards in judicial proceedings in Montenegro" continues to provide support to the national authorities in implementation of EU legislation and relevant case law of the European Court of Human Rights (ECtHR) on procedural safeguards in criminal proceedings. This entails the development of recommendations for legislative and policy changes and support in their application.

In the given context, the base line study on the victims’ rights in criminal proceedings will be developed, with the aim to provide recommendations for effective transposition of the EU Directive and ECtHR standards in the national legislative practices. This will ensure that in all contacts with competent authorities operating within the context of criminal proceedings victims are recognised and treated in a respectful, professional and non-discriminatory manner.

With that aim, the first expert mission took place on 29 November 2019. The group of one international and two national consultants had the opportunity to conduct meetings with the Action beneficiaries: Supreme Court, Chief State Prosecution and representatives of the civil society, to gather feedback and validate the findings with beneficiary institutions. The draft Analysis will be finalised by the end of March 2020.

The Action "Improved procedural safeguards in judicial proceedings in Montenegro" is a part of the joint EU/Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
