The seminar "Specific aspects of the application of Articles 5 and 6 of ECHR at the national level" was organised for the legal expertise service and judicial assistants of the Court of Cassation of Armenia. Participants improved their knowledge and skills:
- In the right to hear witnesses in trials under Article 6 § 1 and § 3(d) and in admissibility of an absent witness evidence in trials and the right to cross-examination as the guarantees to equality of arms and adversarial proceedings.
- In the admissibility of evidence under Article 5 of ECHR. Particularly the issues related to “unlawful detention”, how the courts should substantiate their decisions on detention or its prolongation, were discussed.
The topics of the seminar were selected based on the problems referred to in the recent applications to the European Court of Human Rights (the European Court) against Armenia. The lawyer from the Council of Europe Department for the Execution of the Judgments of the European Court of Human Rights and the Head of the Office of the Representative of the Government of Armenia in the European Court contributed to the seminar.
This event was organised in the framework of the project “Supporting the criminal justice reform and harmonizing the application of the European standards in Armenia”, funded by the European Union and the Council of Europe and implemented by the Council of Europe in their Partnership for Good Governance II.
