Legal certainty and the quality of law: Concepts, Challenges, and Comparative Perspectives

The Venice Commission of the Council of Europe, organised in co-operation with the House of Representatives of the Kingdom of Morocco and the Parliamentary Assembly of the Council of Europe (PACE), an international seminar on "Legal Certainty and the Quality of Law: Concepts, Challenges, and Comparative Perspectives" on 6 - 7 May 2025, in Rabat, Morocco.

The seminar brought together members of the Venice Commission from France, Italy, Monaco and parliamentarians from the Moroccan House of Representatives and the Parliamentary Assembly of the Council of Europe. It aimed to present the Venice Commission's standards and European best practices for improving the quality of law. Quality legislation helps ensure better governance, strengthens citizens' trust in their institutions, and improves the economic and social environment.

*In his opening remarks, the Speaker of the House of Representatives, Hon. Rachid Talbi El Alami, stressed the importance of the topic and the need for parliamentary and democratic culture to cover all functions of the Parliament, and ensuring the quality and efficiency of national legislation.

Deputy to the Secretary of the Venice Commission of the Council of Europe, Pierre GARRONE, stressed the importance of legal security as a fundamental pillar to ensure stability and clarity of legislation, referring to the central principles facing the work of the Venice Commission, namely: legitimacy, security, prevention, equality and access to justice, with a focus on accessibility to jurisprudence. *

The seminar included three working sessions on predictability in and through law, public’s access to laws and organising discretionary powers to prevent arbitrary decisions. Participants discussed several topics, including the clarity and accessibility of standards, legislative coherence, legal predictability, and the limitation of discretionary power to avoid legal uncertainty.

The seminar was organised in the framework of the joint European Union-Council of Europe South Programme V, co-financed by the two organisations and implemented by the Council of Europe.
