Further steps taken towards strengthening the rights of persons deprived of liberty

The Action "Improved procedural safeguards in judicial proceedings in Montenegro" supports Montenegrin authorities in further aligning of the legal framework with the EU acquis and case law of the European Court of Human Rights to ensure that the rights of persons involved in judicial proceedings, in particular persons deprived of liberty, are effectively protected.

To this end, a baseline study on the application of the European Convention on Human Rights’ standards regarding the right to a reasoned decision is being developed within the Action. The study will offer recommendations to further enhance the rights of persons deprived of liberty.

A team of one international and two national consultants had the opportunity to meet the relevant state authorities and civil society organisations in the period 11-13 December 2019, to discuss the vital issues and gather necessary data to develop the Analysis. The draft Analysis will be finalised by the end of March 2020.

The Action "Improved procedural safeguards in judicial proceedings in Montenegro" is a part of the joint EU/Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
