Работата во оваа тематска област се фокусира на затворите и полицијата (вклучувајќи ги и човековите права во полицијата, здравствената заштита во затворите и заштитните мерки против тортура и малтретирање), стандардите за човекови права во судството (фокусирајќи се на подобрување на примената на судската пракса на Европскиот суд за човекови права), миграциските прашања, ефикасноста на правосудните системи (со фокус на анализа на судската статистика за оптимизирање на судските администрации) и/или правна соработка (која се концентрира на зголемување на индивидуалната независност на судиите и обвинителите и одговорноста на правосуден систем).

Back The concept of the legal clinical education in Montenegro framed

With the aim to build the capacities of the law faculties of Montenegro to integrate the practical human rights education into the regular curricula, the concept of human rights legal clinics was developed and presented on 30 June 2020 during the online meeting that brought together the representatives of the Montenegrin law faculties.

In line with developed concept, the legal clinics will be implemented during the academic year 2020/2021. The work will be organised in two semesters, focusing both on the theoretical and practical knowledge relating to women’s rights, in particular in the case of domestic violence and abuse, discrimination, the rights stemming from the social and health insurance, the right to maintenance, the rights as a parent and other questions of parental responsibility.

The adopted model is based on in-house real-client clinic organised in co-operation with the law firms, courts, local and national governmental bodies and non-governmental sector. It will include the simulated clinical legal activities, especially as a part of the training for the students, including topics relevant for developing practical skills such as interviewing and advising, legal writing and drafting, practical legal research, organising and strategising, advocacy and presentation, reflection and assessment. There will be simulated clinical legal activities, such as the first instance procedure. It will furthermore combine classroom experience with real cases or projects, under the supervision of legal professionals whose background includes extensive law practice. The clinics will be implemented in close co-operation with associations of students.

The action "Improved procedural safeguards in judicial proceedings in Montenegro" is a part of the joint European Union/Council of Europe programme “Horizontal Facility for the Western Balkans and Turkey 2019-2022”.
