New Handbok on ECHR case law to strenghten judicial practice in Montenegro

A new Handbook on selected case law of the European Court of Human Rights (ECtHR) is now available in Montenegrin and English, offering legal practitioners a valuable tool for aligning domestic judicial practices with international human rights standards.

Developed in cooperation with the Supreme Court of Montenegro, the Handbook aligns with the Court’s priority of enhancing the application of the ECtHR jurisprudence in a daily work of courts. This effort aims to strengthen public confidence in Montenegro’s judicial system. To this end, the Supreme Court actively participates in the Network of the Highest Courts, established at the ECtHR in Strasbourg, that serves as a vital platform for exchanging information between the European Court and national courts regarding case law, Convention law, and domestic legal frameworks.

The Network has proven to be an effective channel for continuous communication, granting access to the latest ECtHR decisions and legal developments. This collaboration ultimately led to the creation of the Handbook, which serves as a practical guide for legal practitioners—including judges, lawyers, and prosecutors—on applying ECtHR standards in their work.

The Handbook development was supported by the action "Strengthening accountability of the judicial system and enhancing protection of victims' rights in Montenegro", which is part of the joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye”.

Horizontal Facility III

The joint European Union and Council of Europe programme “Horizontal Facility for the Western Balkans and Türkiye” (Horizontal Facility III) is a co-operation initiative, running from 2023 until 2026.

The programme covers actions in Albania, Bosnia and Herzegovina, Kosovo*, Montenegro, North Macedonia, Serbia and Türkiye. It enables the Beneficiaries to meet their reform agendas in the fields of human rights, rule of law and democracy and to comply with European standards, which is also a priority for the EU enlargement process.

The third phase of the programme is worth €41 million (85% funded by the European Union, 15% by the Council of Europe).
