Brief description of the practice: The region of Flanders has defined that, in different advisory boards, a maximum of two-thirds of the members can be of the same sex. If the organisation is not compliant, then the concerned ‘advisory board’ cannot give legally-binding advice. This means that, when the board has to give its opinion on a decision that has to be taken, the advice it can give will not be legally binding. As a consequence, the decision taken by the authority in question will not be legally binding either and could be lawfully challenged. This rule mainly concerns the Flemish Sports Council, which is the advisory board to the Flemish Government, Parliament and Ministry of sports, the Steering Committee Top Sports, another advisory board to the Flemish Government, and municipal advisory councils responsible for sport.
