Q: I would like to know if a team led by me as an individual may send a tender, or do I have to send the tender through one of my universities?

A: In the Tender File, Chapter A. Tender Rules, paragraph 3 it is stated who can apply to this tender:

"The tenderer must be either a natural person, or a duly registered company under sole proprietorship of a natural person, or equivalent, provided that the signatory of the Act of Engagement is individually liable for all obligations undertaken by the entity and is the owner of the moral rights in any creations of the entity. If contracted by the Council of Europe, the signatory of the Act of Engagement shall provide the deliverables personally, in accordance with the terms as provided in the present Tender File and Act of Engagement."

Q: The document Tender File / Terms of Reference states that “between €2,000 (or €5,000 for intellectual services) and €55,000 tax exclusive”. What does this mean for a Provider? What is the range of sums to be filled in the table in the document “ACT OF ENGAGEMENT” where a total exclusion level €5000 is stated?

A: The Tender File in A. Tender Rules states:

“This tender procedure is a competitive bidding procedure. In accordance with Rule 1395 of the Secretary General of the Council of Europe on the procurement procedures of the Council of Europe, the Organisation shall invite to tender at least three potential providers for any purchase between €2,000 (or €5,000 for intellectual services) and €55,000 tax exclusive.”

This specific tender procedure aims at concluding a one-off contract for the provision of deliverables described in the Act of Engagement.”

This paragraph describes the tendering procedure that will be applied for this tender (competitive bidding procedure), the type of contract to be awarded through this procedure (one-off contract) and what is the possible range of amounts for any purchase under this procedure and that the Council of Europe for such procedure must invite at least three potential providers.

The specific Act of Engagement linked with this Tender File further defines the maximum amount for this concrete purchase of services under this tendering procedure, i.e. max. 5000€.

The Act of Engagement further states that:

“Tenders proposing a fee above the exclusion level will be entirely and automatically excluded from the tender procedure.

The Act of Engagement includes the exclusion level at 5000€. This means that total fee for all the deliverables (total sum of individual fees of all deliverables) described in the Act of Engagement to be filled in cannot exceed 5000€.
