In Albania the preparation of the new Draft Law “On the Finalisation of Transitional Ownership Processes”, is continuing, in a process of consultations with different actors and stakeholders. The working group engaged in the preparation of this Draft Law was gathered to discuss the first integrated version of the Draft Law, with the participation of three Council of Europe experts, who attended the discussions and shared with the members of the working group important assessments on the conformity of the revised version with the recommendoations provided by the Opinion from Venice Commission on 14 October 2019.
The Draft Law aims to provide effective legal instruments for resolving a remaining set of problems related to property rights on immovable properties and registration issues, which have dominated the country’s socio-economic development for three decades. The role of the Council of Europe experts in the revision process is to address the issues of compatibility of the Draft Law with Article 1 of the First Protocol to the European Convention on Human Rights and other provisions as well as with the Albanian Constitution.
The EU and Council of Europe joint Action “Supporting enforcement of judicial decisions and facilitating execution of the ECtHR judgments”, part of the Horizontal Facility for the Western Balkans and Turkey, is assisting Albanian authorities in preparing this Draft Law, which should be adopted by the end of 2019 and will contribute in the finalisation of transitional ownership processes in Albania in a defined period of time, in line with the European standards.
