Support to the Moldovan Bar Association: Ethics Commission Workshop on decision-drafting

On 28 November the "Support to the Moldovan Bar Association" component of the PCF Project on Strengthening the efficiency of justice and support to lawyers’ profession in the Republic of Moldova, organised in Chisinau a workshop on decision-drafting for the members of the Ethics Commission of the Moldovan Bar.

The objective of workshop was to improve the legal drafting and reasoning skills of members of the Ethics Commission of the Moldovan Bar. As a result of the workshop, the members of the Ethics Commission familiarised themselves with the CREAC (Conclusion, Rule, Explanation of Rule, Analysis, Conclusion) and IREAC (Issue, Rule, Explanation, Application and Conclusion) methodologies for legal analysis and revisited the facts analysis and the formal requirements of the Ethics Commission’s decisions. Better reasoned decisions positively impact lawyers’ awareness of professional rules of ethics and, consequently, their compliance. These in turn benefit the clients of legal services and the administration of justice in the country.

Mr. Vitalie Tabirta, the chairman of the Ethics Commission, appreciated the workshop as very useful. In his words “it is very important that the Ethics Commission’s case law is based on very well structured and reasoned decisions, given the high society’s expectations towards the lawyers’ profession. The lessons learned and experience exchanged with the trainer will be applied by the members of the Commission in their work”.

The training was conducted by Mr. Irakli Kordzakhia, chair of the Georgian Bar Association Disciplinary Body (2010-2011) and accredited lecturer in professional ethics in Georgia.

The component on the "Support to the Moldovan Bar Association" of the "Strengthening the efficiency of justice and support to lawyers' profession in the Republic of Moldova" project is funded by the Programmatic Cooperation Framework for Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus. The Council of Europe and European Union are working in partnership with Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus to help them meet Council of Europe benchmarks in human rights, democracy and the rule of law and improve the lives of citizens.
