Georgian judges showing strong commitment to apply case-law of the European Court of Human Rights in their rulings

On 20 May 2017, the Council of Europe with the participation of the Chief Justice at the premises of Supreme Court of Georgia, within the EU-funded project, organised a workshop for judges and staff of analytical units of court system on the “Application of the European Convention on Human Rights and decisions of the European Court of Human Rights by the common courts of Georgia” 

The workshop was a follow-up activity to familiarise judges on the main findings of the CoE/EU research on “Application of the Standards of the European Convention on Human Rights by the Common Courts of Georgia” presented to the general public on 5 April 2017.

Participants of the workshop examined the best practices of application of the standards set by the European Court by Georgian courts, so that this trend is replicated by other courts of Georgia during the consideration of similar cases. They also analysed those instances, when the European Court of Human Rights standards were not applied correctly, or were only partially applied by Georgian courts. Subsequently,  the Council of Europe gave an overview of the recommendations from the research for a better application of the human rights standards. Moreover, participants discussed challenges and possible solutions to remaining issues with the application of the these standards.

As a result of the workshop more than 50 Judges learnt about the main findings of the research and are able to apply best examples of application of European Convention on Human Rights and the case-law of the European Court of Human Rights in their decisions.

The event was organised in the framework of the European Union – Council of Europe joint project “Application of the European Convention on Human Rights and harmonisation of national legislation and judicial practice in Georgia in line with European standards”, being implemented under the EU-CoE Partnership for Good Governance.
