Georgia interested to identify the full depth and nature of issues related to pre-trial detention

On 11 January, 2017, Council of Europe (CoE) in co-operation with the Ministry of Justice of Georgia presented the Assessment Tool on Pre-trial Detention which elaborates in detail the methodology for internally reviewing pretrial detention practice.

The document offers a step by step methodology on the use of statistical and thematic analysis to assess the application of pre-trial detention and uncover problems connected to its use, which, in turn, will help to arrive at best solutions. Development of the tool is first-of-its-kind attempt to provide a systematic approach to collection and analysis of available data to achieve an objective picture of the use of pre-trial detention.

Representatives of the Ministry of Justice, Supreme Court, Common Courts, Chief Prosecutors’ office, Public Defender’s office, practicing lawyers and leading Georgian non-governmental organisations working in the area of human rights attended the public presentation. Willingness and interest to continue with further dissemination and implementation of the tool was expressed by the Georgian authorities.

CoE stands ready to additionally support state authorities to adopt this unified methodology which in the long run will result in harmonisation of the use of detention with the European concept of detention in the Member States.

The development and presentation of the Assessment tool was organised in the framework of the European Union – Council of Europe joint project “Application of the European Convention on Human Rights and harmonisation of national legislation and judicial practice in Georgia in line with European standards”, implemented under the EU-CoE Programmatic Cooperation Framework
