Support to the Moldovan Bar Association: integrating human rights based approach in policies and practices

A half-a-day workshop was held on integrating a human rights based approach into the Moldovan lawyers’ profession, on 10 November in Chisinau. The objectives of the workshop were to upgrade the knowledge of participants on the human rights based approach, share best practices in integrating the human rights based approach in European lawyers professions and to agree on next steps to enable the effective integration of the approach into the Moldovan Bar Association's policies and practices. The Human Rights Based Approach is one of the tools to analyse and improve policies and practices of an organisation aspiring to become a defender and promoter of human rights, in line with the country’s international obligations.

The workshop was opened by Mrs Nina Lozan, the president of the Moldovan Bar Association (MBA), who thanked the Council of Europe and the European Union for the support provided to the Bar's initiatives to strengthen the role of the profession on the justice sector landscape. The workshop was attended by the MBA President, members of the MBA Council, Ethics and Discipline Commission, Licensing Commission, Censors Commission and representatives of the Women Lawyers Association and the Young Lawyers Association. The workshop was conducted by Ms Ana-Maria Telbis, president of the Executive Board, European Human Rights Association, and Ms Nadejda Macari, national consultant. The issues debated and discussed included lawyers participation and involvement in the MBA functioning,  the application of the principles of equality and non-discrimination within the profession, the contribution of the profession in integrating human rights into public policies. The discussion was enriched with best practices across the profession in Council of Europe members States and international and regional professional organisations’ resources and guidelines inter alia on strategic litigation, participation in law making, cooperation with civil society.

As a result of the workshop, the MBA expressed readiness to integrate the human rights based approach into its 2016-2020 Organisational Strategy and make a more active use of international and national mechanisms to protect and promote human rights both international and on the public agenda. 

This workshop forms part of the activities of the component on the "Support to the Moldovan Bar Association" of the "Strengthening the efficiency of justice and support to lawyers' profession in the Republic of Moldova" project is funded by the Programmatic Cooperation Framework for Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus. The Council of Europe and European Union are working in partnership with Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus to help them meet Council of Europe benchmarks in human rights, democracy and the rule of law and improve the lives of citizens.
