Support to the Georgian Bar Association: forward thinking legislative amendments

A discussion on legislative amendments to the Law on Advocates of and the Lawyers Code of Ethics was organised on 4-5 December in Kakheti, Georgia. The meeting is a follow up of two round-table discussions supported with international expertise provided by the PCF Project “Support to the Georgian Bar Association”. During this concluding meeting in Kakheti, the GBA Executive Board and the Ethics Commission members discussed CoE experts’ recommendations on the draft amendments to the Law on Advocates and the Code of Ethics.

The participants, inter alia agreed on the following issues:

  • The GBA definition and mandate to be provided under the Law, in compliance with the Council of Europe Recommendation Rec(2000)21 of the Committee of Ministers to member states on the Freedom of Exercise of the Profession of Lawyer.
  • The rotation principle for the members of the GBA Executive Board and Ethics Commission to be introduced. As a result, members of these bodies will automatically be replaced by those who received the highest number of votes from the General Assembly.
  • An intermediary sanction in the form of public reprimand to be added to the list of ethical violations.
  • Sanctions for intern-laweyrs have been envisaged in cases of ethical/disciplinary violations.

As a result of the meeting, GBA plans to submit the draft amendments to the Parliament for consideration in its Spring session.

This meeting took place under the EU/CoE Joint Project "Support to the Georgian Bar Association", which is funded by the Programmatic Cooperation Framework for Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus. The Council of Europe and European Union are working in partnership with Armenia, Azerbaijan, Georgia, Republic of Moldova, Ukraine and Belarus to help them meet European standards in human rights, democracy and the rule of law and improve the lives of citizens.
