Working Session “International and Regional Mechanisms for the Prevention of Torture”

A Working Session “International and Regional Mechanisms for the Prevention of Torture” organized jointly by the Ministry of Justice of Ukraine and the Ministry of Foreign Affairs of Ukraine was held at the Ministry of Justice of Ukraine on 15 August 2016 in Kyiv.

The Working Session was supported by the Council of Europe in the framework of the EU/CoE joint project “Consolidation of Justice Sector Policy Development in Ukraine”, United Nations Development Programme in Ukraine, United Nations Office of the High Commissioner for Human Rights and UN Human Rights Monitoring Mission to Ukraine.

The aim of the event was to train representatives from governmental agencies of Ukraine responsible for places of deprivation of liberty on the mandate and modus operandi of the international (United Nations Subcommittee for the Prevention of Torture, SPT), European (European Committee for the Prevention of Torture, CPT), and national (National Preventive Mechanism, NPM) bodies monitoring the treatment of persons deprived of their liberty by the public authority.

The experts delivering the training part of the working session were Dr. Mykola Gnatovskyy, President of the CPT and Mr. Arman Danielyan, member of the SPT. Ms. Lutkovska, Ukrainian Parliament Commissioner for Human Rights, made a presentation on human rights monitoring of the places of depravation of liberty at the national level.

The following issues were covered by the experts: background and philosophy of the monitoring places of deprivation of liberty, facilities which can be visited by the SPT and the CPT, practical aspects of the SPT and CPT visits, such as composition of the delegation, access to the closed institutions, access to persons, premises and documentation, confidentiality, other issues.

The participants were representatives from the Security Service, Ministry of Justice, State Penitentiary Service, Ministry of Foreign Affairs, Office of the Ukrainian Parliament Commissioner for Human Rights (Ombudsperson) and, in particular, the NPM Department thereof, Ministry of Defence, State Border Guard Service, Ministry of Healthcare, State Migration Service, General Prosecutor’s Office, and National Police.

Participants expressed their deep interest in the work and standards of the CPT and SPT and were provided with some guidelines from the experts for the upcoming monitoring visits.
