Trainings on human rights protection for heads of qualification and disciplinary chambers of the Qualification and Disciplinary Bar Commissions

EU/CoE joint Project “Consolidation of Justice Policy Development in Ukraine” supported trainings organized by the Ukrainian National Bar Association (UNBA), hold on 5-6 and 12-13 December 2015, for heads of qualification and disciplinary chambers of the Qualification and Disciplinary Bar Commissions on application of the European Convention on Human Rights and the European Court of Human Rights (hereinafter - ECHR) case-law, envisaged by the qualification exam program.

During the seminars the presentations were made by the following speakers: Oleksandr Drosdov, Head of the High Qualification and Disciplinary Bar Commission, Ihor Karaman, coordinator of the UNBA for continuing legal training of attorneys, lawyer at the ECHR Registry (2008-2012), Nazar Kulchytskyy, partner at the Kulchytskyy, Kulakov & Bidniahin Law Firm, Government Agent before the European Court of Human Rights (2012-2013), Daina Selma, lawyer at the ECtHR, Taras Pashuk, lawyer at the ECtHR.

The following issues were covered during the trainings: the role and place of the Convention in the system of protection of human rights and freedoms in the framework of the Ukrainian legal system; the right of citizens of Ukraine to apply to the Council of Europe bodies; conditions and procedure for lodging application before the ECtHR (eligibility criteria); the proceedings before the ECtHR; right to an effective remedy; friendly settlements at the ECtHR; measures of individual and general matter; execution of ECtHR judgements; right to life and positive obligations of the state; prohibition of the death penalty, extradition and expulsion; prohibition of slavery and forced labor; prohibition of torture, inhuman and degrading treatment or punishment; right to liberty and security; compensation for wrongful conviction; freedom of movement; right to a fair trial; right to respect for private and family life; protection of property;

freedom of expression; freedom of assembly and association; prohibition of retroactivity of criminal law; the concept of discrimination and its development in the practice of the ECtHR; freedom of thought, conscience and religion; right to education; right to free elections.

The presentations referred to the ECtHR case-law were combined with the practical assignments on the admissibility of complaints before the ECtHR and with current issues on application of the ECtHR case-law during the application of the legislation of Ukraine.
